There are no refunds. All sales are final. In the case of a technical problem management may issue a credit or refund after investigating and confirming the situation. Refunds may be provided in a format other than the credit card used at the time of purchase. You agree that you will not initiate a refund from your credit card company because of regret, change of mind, lack of response, or because you didn't like the response. Any investigation will result in your complete message(s) being provided to your credit card company as proof of agreed upon service.
For a small fee BFF will allow you to contact any member. You agree our role is only to deliver the message to the recipients inbox on our website. (If the recipient has configured email and sms text alerts we attempt to contact them by this method, but this is not guranteed.) Messages, are paid for and delivered immediately, each party will be able to review the other. You agree the review and feedback system is adequate for you to make a decision about paying to contact a member or purchasing a gift for a member. Members receiving three reviews of 10/25 or below will be disabled and not allowed to use the site. You agree your "review" is your only recourse if you do not get a response. You agree to be fair as possible in your review. Remember they will be able to review you as well.
When purchasing physical gifts, you understand there are no refunds. In order to minimize mismatches between members, the recipient has 48 hours to accept a gift request. If the recipient does not accept your offer, the gift request is cancelled automatically. You pay nothing. Niether party has the right to a review. Once the gift is accepted, paid and delivered, each party may review the other. After purchasing and attempting to deliver a gift on your behalf, we have incurred all the costs associated with performing the service. If the recipient has provided incorrect information, declines the physical delivery, or is not available for delivery, we cannot be responsible for this situation. After one or two reasonable attempts, we cannot continue trying to deliver a gift and your purchase price cannot be refunded. We cannot be responsible for long delivery lengths, especially in foreign countries. You understand that delivery services and mail work very differently in other countries. For example, in Brasil, we have seen 3 week delivery times and lost mail. Gifts cannot be redirected to alternate addresses. Including your own address.
Indeminification, Jurisdiction and Language You agree to hold BFF and its parent company Oceanview Software LLC, owners, employees, affliates, investors, suppliers and associates harmless in all cases. By using the site you further agree to resolve any disputes directly with the LLC by talking with them in good faith to resolve your issue. As a last resort, you agree to file any legal procedings in the county of Miami-Dade in the State of Florida, USA. The english version of this document is the official version. We are not responsible for any errors due to translation into another language.Use at your own risk
The LLC will attempt everything reasonable to keep you safe and your information safe and the site working properly. We utilize a feedback system to monitor members, please utilize it. Past performance is not a 100% predictor of future performance. By logging into the system or using the system you agree to all rules and accept all warnings. You agree you are 18 years of age or older. You further agree that any of your information that you submit to the site, or is sent to you, is saved in the system. This data may also be provided to financial institutions in the event of a billing dispute or law enforcement if the LLC has reasonable belief that someone's safety is in danger. This includes but is not limited to, personal information, financial account information, photos, messages, sms texts and emails.
Anyone can be banned for any reason. Ocean View Software, LLC d/b/a BFF and its owners, employees, contractors or affiliated people are not responsible to you for anything. Includeing, but not limited to your safety, lost wages, damages, computer/device damages, punitive settlements, travel expenses or any type of consideration. This site is an experimental cutting edge social experiment. Do not participate if you cannot afford the risk of buying a gift for someone or paying a small fee to attempt to contact them. We do not do background checks or verify anyone on the site, you are responsible for your safety.

BFF is not responsible for these examples (and not limited to these examples):
- If you choose to meet another member in person and they have mental issues, are criminals, have criminal records, are insane, are unsafe or anything going wrong from meeting someone in the real world.
- "Catfish" scam. Where someone represents themself to be someone else through false images and descriptions. You agree to use the feedback system as your sole recourse.
- "Romantic Scams" usually from Nigeria, Jamica or a foreign country. Someone sends you a check and asks you to write a check to another person. Their original check bounces, leaving you paying for the amount you sent.
- "Romantic scams" any type of fraud or deception to get money from you. Bank and credit card tricks. Wire fraud, "borrowing money", "investments", etc. Never share your financial information or send large amounts of money to anyone.
- The site getting hacked and personal information compromised. (Check the "account" tab to see all the info we have about you.)
- Members that don't like you, or ignore you, or don't respond.
- The site damaging your computer, tablet or phone in anyway. Getting a computer virus.
- Lost emails, slow emails, or technical glitches that might negatively impact you.
- Someone you hire from the events section not showing up at the worksite or doing the job properly. Possibly interfering with your event. Lost business or customers.
- A member not paying you as agreed or anything going wrong with an event listing. You agree to use the feedback and review system as your only recourse for event listings.
- A member shares private information or images of you, that you did not consent to share.
- A member not cooperating to receive a delivery. Gifts cannot be delivered without cooperation from the recipient. The recipient may need to be home at a certain time or may need to go to a courier distribution center to pick up a gift.
- A member not providing the correct address. This could cause your perishable gift to spoil or not be delivered at all. In these cases, we have spent the money and labor to to attempt to deliver your gift. You are not entitled to a refund. You may only leave negative feedback for the member.
Code of Conduct
You are not allowed to use the site to post or send hate speech, harrasing or threatning language. You are not allowed to use the site in anyway to attack, bother, embarass or annoy someone. This includes pretending to be someone you are not. This includes distrubuting information or images that were given to you through this site. Any nude photo you receive from any member is automatically considered private. You will be banned from the site and refered to law enforcement for sharing private information or images of another user.
No nudity is allowed on the site publicly. You may put a password on nude photos if you wish to share them privately. You cannot share obscene content or content for which you do not own the rights. The site cannot be used for sexual services or money laundering. The site cannot be used to do anything illegal, or arrange or manage anything illegal. BFF wants to maintain a professional image and appearance. We want to have good standing in all local and international communities. We want everyone to feel comfortable on the site. Your actions should be consistent with this corporate image. Your account can be disabled or photos altered or deleted for violating content rules.
The site reserves the right to remove any content it finds objectional for any reason. You agree there is no recourse for you and BFF is not responsible for any loss or damages to you. This is private property and you will act in accordance with the LLC's wishes. If you do not agree, do not use the site. Mark your account inactive and do not return.
You agree the LLC has the right to hold your content in connection with hosting your profile or listing. This includes written words as well as pictures, videos or ideas. Anything you might insert or upload to the site. Once your data is in our system it may continue to exist after deleting it. It can also exists in backups for long periods of time. We recommend not sending information to other members that you would not want to share publicly. We cannot be responsible for members handling of your private or non-public information or data.
You are not allowed to use this site for fraudulent purposes. False pictures, false descriptions, false representations or false statments are not allowed. Trying to hack or cheat the payment system is not allowed. Trying to hack the site or gain access to information that does not belong to you is not allowed. If the LLC or any of its employees, representatives or affiliates believe you are involved in this type of activity you can be banned from the site, at our sole discretion. We also reserve the right to pursue legal action against you at our discretion. This includes cooperation with law enforcement and providing law enforcement any of your information or images. You agree you will be responsible for any legal cost necessary to deal with your actions. This includes if your actions are found to be legal or illegal by a court of law. We also reserve the right to give out your information to someone who wants to pursue legal action against you, if and only if the situation is extremly significant and the LLC feels it's a threat to our business or the safety of one of our members in an imminent and clear way.
